1. Acceptance of Terms
By accessing or using the Mshena platform ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
Mshena reserves the right to update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms.
2. Definitions
"Platform" refers to the Mshena website, mobile applications, and all related services.
"User" means any individual who accesses or uses the Platform, including tourists, tour guides, and tour providers.
"Provider" refers to any business or individual offering tourism experiences, programs, or services through the Platform.
"Guide" refers to licensed tour guides registered on the Platform.
3. Use of Services
The Platform provides a marketplace connecting tourists with licensed tour providers and guides in Saudi Arabia. Mshena facilitates bookings but does not directly provide tourism services.
- Users must be at least 18 years old to create an account.
- Users are responsible for providing accurate information.
- Users must comply with all applicable Saudi Arabian laws and regulations.
- Users must not use the Platform for any unlawful or unauthorized purpose.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Mshena immediately of any unauthorized use of your account.
Mshena reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
5. Bookings & Payments
All bookings made through the Platform are subject to availability and confirmation by the relevant Provider or Guide.
Prices are displayed in Saudi Riyal (SAR) and include all applicable taxes unless otherwise stated. Payment processing is handled securely through our certified payment partners.
- Full payment is required at the time of booking unless otherwise specified.
- Booking confirmations are sent via email and appear in your account dashboard.
- Tour guide quote payments must be completed within 24 hours of acceptance.
6. Cancellations & Refunds
Cancellation policies vary by Provider and are clearly displayed on each listing. Generally:
- Free cancellation up to 24 hours before the experience start time.
- Cancellations within 24 hours may be subject to a fee.
- No-shows are not eligible for refunds.
- Refunds are processed within 5-10 business days.
7. Tour Guide Services
All tour guides registered on the Platform must hold valid Saudi tourism licenses. Mshena verifies guide credentials but does not guarantee the quality of individual tours.
Guides are independent contractors and not employees of Mshena. Any disputes between Users and Guides should be reported to Mshena support for mediation.
8. Limitation of Liability
Mshena shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform or any tourism services booked through it.
Mshena's total liability shall not exceed the amount paid by the User for the specific booking in question.
9. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of Mshena or its content suppliers and is protected by intellectual property laws.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Saudi Arabian courts.
